As you choose to share your interests and preferences with us, we will be able to make your online experience with us more enjoyable and rewarding, and consequently, give you the lowdown on our Terms & Conditions.

  • If you choose to provide us with your personal information, we will be able to provide you with a better, more personalized experience over time. But it’s completely your choice. Gabbyville aims to respect and protect your privacy, as explained in this policy.
  • If you so choose, we will contact you regularly by e-mail.
  • From time to time, we will ask you to tell us what you like and what we should add or change on our website. Participation is completely voluntary.
  • If you request that we not contact you for marketing purposes, we will not. However, if you are interested, we may keep you informed about special offers on our products and services.

Gabbyville® Virtual Receptionists Terms and Conditions

Emerge Telecom International, LLC DBA Gabbyville Virtual Receptionists (“Gabbyville”) hereby agrees to provide various Telecommunications Services to Client pursuant to the Terms and Conditions set forth herein and in the Service Agreement.

Term

This agreement shall be for a term of 30 days and shall automatically renew unless 30 days prior written notice has been given to the other party; however, if either party is in material default of this agreement, the other party may cancel this agreement pursuant to the terms below. Subscriber can hold/suspend services for a minimum of 30 days only if customer provides a written 30 day notice to suspend services. Subscriber will automatically be invoiced after hold/suspension is lifted after the 30 day suspension renewal. For example if subscriber has a renewal date on March 1st then customer must provide a 30 day written notice to suspend services on Feb 1st. Subscriber suspension will start on March 1st for 30 days and then renew on April 1st. Subscriber is still responsible for payment if 30 day notice is not received to cancel services.

Your Service Plan begins on the date of your first payment for your selected Services Plan (“Subscription Date”). By subscribing to the Services, you agree to pay all fees for your selected Service Plan, plus any overage charges incurred. All payments are non-refundable.

In the event that you exceed the number of Receptionist Calls during a calendar month of the Services, you will be charged overage charges as described in the plans found at https://www.gabbyville.com/pricing-monthly. Overage charges will be charged on the last business day of each month or, if your Service Plan is terminated, are required to be paid within 3 days of the termination date of your Service Plan. You authorize Gabbyville to charge the payment method on file for any overage charges incurred. Subscriber is also allowed to upgrade to a larger plan at any given time during their billing cycle to avoid overages.

Subscriber may change the Service Plan at any time by notifying Gabbyville at support@support@gabbyville.com or 1-800-903-7141. The Plan change must be made at least one week prior the end of the current subscription cycle. If the Subscriber changes the Service Plan within one week of the end of the cycle, the current Service Plan will continue following month and change at the next subscription cycle. For example, if the Service Plan subscription is set to renew Friday, change by the previous Friday to prevent an additional month at the current plan.

First 30 Days

During the first 30-Days of service, services are cancelable by either party at any time.

 

Payment

Regular service shall initiate on the date set forth in the Service Agreement.
On or before the first of the month immediately following Initiation Date, and on or before the first of every month thereafter, Client shall pay Gabbyville the Monthly Charge.
In addition to the Monthly Charge, Variable Charges may be assessed pursuant to the Service Agreement.
All payments must be received by Gabbyville no later than 30 days after Due Date. The Due Date for the Monthly Charge is the first of the month for which service is provided. The Due Date for the Variable Charges is the first of the month immediately following the month for which service is provided.
Client shall, at all times, maintain a valid Credit Card(s) on file with Gabbyville. Client hereby authorizes Gabbyville to debit Client’s Credit Card(s) to satisfy any and all amounts due to Gabbyville.
In the event Gabbyville does not receive full payment within 3 days of Due Date, Client will be considered to be in Material Default of this Agreement and Gabbyville shall have the right to immediately terminate service without waiving the right to collect any and all amounts then due plus all Late Fees that may accrue thereafter.

Late Charges

Any payment(s) not received within 30 days of the Due Date, and every 30 days thereafter, are subject to a Monthly Late Charge equal to $30 or 15% of the amount then due, whichever is greater.

Confidentiality

Gabbyville will use reasonable care to maintain the confidentiality of Client confidential information provided to Gabbyville in the course of providing the Telecommunication Services. Gabbyville will not disclose or use such confidential information, except as authorized by Client or otherwise compelled by law. Client’s confidential information shall not include any information in the public domain through no fault of Gabbyville, or information received from a third-party having the right to transfer such information.

Liability

Gabbyville makes no representations or warranties, express or implied, of any kind to Client or a third-party regarding Gabbyville’s services. Gabbyville shall use reasonable efforts to provide the agreed upon services; however, in no event, shall Gabbyville be liable to Client, or any third-party, for any claims for loss or damages as a result of any action or inaction by Gabbyville.

Children’s Privacy Policy

Children under 13 years of age should not access any interactive portion of this website without first obtaining parental permission. If a child under 13 years of age wants to participate on the web site, we encourage the child’s parents to participate on the child’s behalf and share the experience of our website accordingly. We welcome family participation. Parent/Guardian consent is required to use Gabbyville.

Miscellaneous

Any telephone number assigned to a Client by Gabbyville shall remain the property of Gabbyville.
These Terms and Conditions and the Gabbyville Receptionist Service Agreement set forth the entire Agreement between the parties. This Agreement shall be binding upon all successors and assigns of the parties hereto.

Overages

Jurisdiction

The laws and jurisdiction of the state of Wyoming shall govern any and all matters of dispute between Gabbyville and Client.
